A settlement agreement with trucking company with Navajo Express announced by the Justice Department (“DOJ”) today a warns other businesses to use care when dealing with non-citizen applicants and workers to avoid violating the Immigration and Nationality Act (INA) while concurrently complying with federal mandates to verify eligibility of each worker to work in the United States.
Federal law generally mandates every employer verify the identity and eligibility to work of each employee to present an acceptable combination of original documents from the choices specified on the Form I-9 that appear valid on their face and complete the employee portion of the Form I-9. Meanwhile, the INA prohibits businesses from discriminating based on national origin in the application of these procedures or other terms and conditions of hiring or employment. The widespread availability and use of high quality, fraudent documentation, misperceptions about requirements and other factual developments require businesses to tread carefully to comply with both of these rules simultaneously.
The Form I-9 and associated rules require employers to require completion of the Form I-9 and the employee to present specified original documents that establish his identity and eligibility to work. Employers can face substantial civil penalties or even criminal prosecution for failing to meet these requirements.
The I-9 rules specify the document or combination of original documents that a worker can use as proof of identity and work eligibility. Since the Form I-9 and the documentation acceptable for proof of identity and work eligibility change from time to time, businesses always should verify they are using to most current Form I-9 and use it to guide decisions about which documents or combination of documents fulfill the proof requirements when presented by an employee. It bears noting that although the most current Form I-9 Form was scheduled to expire in October, 2022, the Department of Immigration and Customs Enforcement (“ICE”) says employers should continue to use that Form for I-9 compliance until ICE releases an updated Form.
Since the widespread availability of fraudulent documents often makes determination if the validity of documents from physical examination alone, the E-Verify Program allows employers to use the E-Verify process to check the validity of the documents for each worker or where the employer is put on notice that the documents presented by a particular worker are not valid. Otherwise, however, if a worker presents any of the allowable combinations of documents specified in the Form I-9, federal law, mandates that the business accept the presented documentation as proof of identity and eligibility to work unless the employer comes into information that puts the employer on notice that the documents that appeared valid, in fact are not genuine.
The INA’s anti-discrimination provision prohibits employers from asking for specific because of a worker’s citizenship, immigration status or national origin. Indeed, many non-U.S. citizens, including lawful permanent residents, refugees and asylees, are eligible for several of the same types of documents to prove their permission to work as U.S. citizens (such as driver’s licenses and unrestricted Social Security cards). Employers must allow workers to present whatever acceptable documentation the workers choose and cannot reject valid documentation that reasonably appears to be genuine. In addition, if a lawful permanent resident provides an unexpired permanent resident card to prove their permission to work, employers must not request new documentation if the permanent resident card later expires.
Navaho Express got nailed for requiring more than what the I-9 rules require for proof of eligibility to work from individuals perceived noncitizens. The Navajo Express settlement resolves DOJ charges Navaho Express violated the INA by discriminating against non-U.S. citizen workers when checking their permission to work in the United States.
DOJ’s investigation began after a non-U.S. citizen complained that Navajo Express refused to accept valid documentation proving his permission to work and demanded a different document from him. DOJ’s investigation determined that Navajo Express routinely required lawful permanent residents to show their permanent resident cards (known as “green cards”) to prove their permission to work, even when they had already presented other valid documentation. The investigation also revealed that Navajo Express had a policy of unlawfully requiring permanent residents to provide new permanent resident cards when their old permanent resident cards expired, even though such documentation is unnecessary under existing rules.
Under the terms of the settlement, Navajo Express will pay more than $40,000 in civil penalties to the United States, train staff on the INA’s anti-discrimination provision, review and revise their employment policies, and be subject to departmental monitoring for a two-year period.
In addition to DOJ enforcement actions like Navoho Express, businesses also can face significant damage awards in lawsuits for discrimination brought by applicants and employees. Consequently, all businesses should use care to ensure their non discriminatory documented compliance with the I-9 rules without impermissible discrimination or retaliation. Businesses should seek help from experienced legal counsel to design and train their Human Resources team about appropriate practices and should seek the advice of legal counsel with questions or concerns about evidence or concerns about the validity or adequacy of documentation or other concerns impacting their compliance with both laws.
